Frank A. DiScipio obtained summary judgment dismissal in favor of a prominent periodontist and dental implant specialist  in Kings County.   Plaintiffs contended that the periodontist should have performed periodontal scaling to remove retained dental cement prior to gum surgery, which eventually resulted in gum recession.  Mr. DiScipio attacked the conclusive and unsupported allegations in the plaintiffs’ expert affidavit, that gum surgery was not required to achieve proper access for the removal of the retained cement,  by arguing that same was speculative, at best.  He further set forth that his client used professional judgment, after a careful and competent examination, to proceed with the gum surgery to remove the dental cement.  The Court agreed, granting summary judgment dismissal as to the periodontist.
