The plaintiffs alleged the doctor failed to inform the mother of a CMV (cytomegalovirus) diagnosis, which unfortunately led to severe brain damage of the infant plaintiff. Ms. Solimeo proved that there was, and still is, no proven treatment for CMV when diagnosed during pregnancy. There was further evidence that the infant suffered an underlying genetic condition which was found to be the primary cause of his severe damages. The Court dismissed the case in its entirety.
