Following a 2-week trial, Marc J. Falcone was successful in obtaining a defense verdict on behalf of a local urologist and his professional group.
The case was venued in Richmond County and involved the allegation that the defendants failed to timely diagnose and treat urothelial cell carcinoma, resulting in the death of the patient at the age of sixty-eight. The jury unanimously determined that the treatment at issue did not depart from the accepted standards of medical practice. In doing so, the jury agreed that the patient’s cancer was not clinically detectable during the time of the treatment in question and that, once detectable, the cancer was very aggressive and spread quickly.
