After a three-week trial, Marc J. Falcone secured a defense for our client, a local gastroenterologist. The case, venued in Kings County, involved the death of a 42-year-old married father of two children. It was claimed that the defendant doctor failed to properly treat pancreatitis, resulting in the patient becoming septic, secondary to undiagnosed pancreatic necrosis, resulting in his passing three days after discharge from the hospital. As part of the defense, it was established that all appropriate and necessary tests were performed, labs were appreciated, and that the patient was improving and stable for discharge. It was also established that the patient’s death was the result of an arrhythmia due to underlying hypertensive cardiovascular disease, with cardiac hypertrophy. The jury found that the defendant provided proper and appropriate treatment and did not depart from the accepted standards of medical practice.
