After a two-and-a-half-week trial, Marc J. Falcone, and Adriana M. Solimeo secured a unanimous defense verdict for our client, a Staten Island pulmonologist. The case was venued in Richmond County and involved the claim of an alleged failure to timely diagnose and treat lung cancer. The patient/decedent, who had an extensive smoking history and a family history of lung cancer, was seen by our client for evaluation of a questionable nodule seen on a chest x-ray. Our client followed the patient with additional CT scans which suggested that the questionable area was due to scarring, and no further imaging was indicated. The patient was diagnosed with stage IV lung cancer a little over two years after the last CT scan, and he succumbed to the disease within a few months. At trial, it was claimed that our client departed from accepted standards of care by not ordering subsequent CT scans, especially given the patient’s smoking history and family history of lung cancer. The defense established that the CT scans were not suggestive of malignancy and instead depicted stable findings which did not warrant further work-up. It was also established that, although he was a smoker, the patient did not meet the criteria for screening for lung cancer with low-dose CT scans. The jury unanimously determined that our client provided proper care and did not depart from the accepted standards of medical practice.
