After a two-week trial, Marc J. Falcone secured a defense verdict for our clients, a local urogynecologist and a hospital system. The case, venued in Richmond County, involved the death of an 81-year-old married mother of two children. It was alleged that the defendants were negligent in performing a contraindicated surgery and that the surgery was negligently performed in that there were multiple perforations of the patient’s bowel, resulting a more extensive surgery, ICU admission and death. There were claims made for pain and suffering and a lack of informed consent. The jury found that the defendants provided proper and appropriate treatment and did not depart from the accepted standards of medical practice.
