After a two-week trial, Marc J. Falcone secured a unanimous defense verdict for our client, a Manhattan urogynecologist. The case was venued in Richmond County and involved the performance of pelvic floor reconstruction surgery. The patient alleged that she was improperly positioned during the procedure and, as a consequence, sustained an injury to the peroneal nerve in her left leg with a resultant foot drop. The defense contended that the patient’s nerve injury was not caused by improper or prolonged surgical positioning. Instead, it was a known but rare consequence of the necessary surgical positioning. The jury unanimously determined that the doctor provided proper care and did not depart from the accepted standards of medical practice.
