After a three-plus week trial, Marc J. Falcone secured a defense verdict for our client, an obstetrician/gynecologist. The case was venued in Kings County and involved the claim that, during surgery to treat an ectopic pregnancy, our client performed an unnecessary and contraindicated bilateral salpingectomy which resulted in the patient not being able to conceive naturally. At trial, it was claimed that our client departed from accepted standards of care by removing both fallopian tubes instead of obtaining an intra-operative frozen section which would have confirmed which tube the ectopic pregnancy was in. The defense established that both tubes were damaged to the point that neither would produce a uterine pregnancy and that both tubes were at a significant risk of rupture if they were not removed. The plaintiff requested $8.5 million for past and future damages and the verdict sheet contained questions regarding medical malpractice and lack of informed consent. After several days of deliberating, the jury determined that our client provided proper care and did not depart from the accepted standards of medical practice and found in favor of our client on both causes of action.
