Following one week of trial, Marc J. Falcone was successful in obtaining a directed verdict on behalf of a prominent obstetrician/gynecologist. The case was venued in Richmond County and involved the allegation that the physician defendants injured the ilioinguinal and iliohypogastric nerves during a surgical procedure and the postoperative care compounded the injury to those nerves. It was alleged that the plaintiff was caused to suffer severe and debilitating pain and numbness and was caused to undergo nerve block treatments.
After one week of trial, which involved cross-examination of the plaintiff’s liability and damages experts, the Court agreed that the plaintiff failed to establish a prima facie case of medical malpractice against the obstetrician/gynecologist defendant. The Court granted the obstetrician/gynecologist defendant’s motion for a directed verdict at the close of plaintiff’s case.
