Michael Ellenberg secured defense verdict on behalf of a retinal surgeo

Michael Ellenberg, Esq.,  secured a defense victory in Supreme Court, Westchester County on behalf of a retinal surgeon.  The plaintiff alleged that the physician improperly performed a YAG Vitreolysis to treat a large, fixed posterior vitreous detachment, which resulted in a retinal detachment.  They also alleged the physician failed to provide a full informed consent as to the risks associated with the YAG Vitreolysis.  At trial, it was established that the YAG Vitreolysis was a proper method for treatment of such a posterior vitreous detachment, and that the physician did provide a full informed consent, laying out the benefits, risks, and alternatives to the treatment.  The jury quickly returned a verdict, finding that the physician neither deviated from acceptable standards of care, and did provide a full informed consent.
